Collapse ▲Ordinance Allowing for the Creation of EVADs/VADs
In 2017, The Yancey County Board of Commissioners adopted “The Yancey County Farmland Preservation Act”. This allowed farms to be enrolled into Enhanced Voluntary Agricultural Districts (EVADs) or Voluntary Agricultural Districts (VADs). The ordinance was last updated by the Yancey County Board of Commissioners in July 2024 to comply with legislatively required and recommended changes from the State of North Carolina.
Why EVADs/VADs are Created
Yancey County has established Voluntary and Enhanced Voluntary Agricultural Districts (EVADs/VADs) to protect and preserve agricultural lands and activities in Yancey County. These districts have been developed and mapped by the county to inform all purchasers of real property that certain agricultural and forestry activities, including but not limited to pesticide spraying, manure spreading, machinery and truck operation, livestock operations, sawing, burning, and other common farming activities may occur in these Districts and Enhanced Districts any time during the day or night.
I Received Notice of EVADs/VADs Within 1/2 Mile of the Property Line on a Deed Search. What does this mean?
If you have considered purchasing property since 2023 in Yancey County, you may have come across a statement in a deed search that declared the property you were considering was located within 1/2 mile of a VAD or EVAD. This just simply means that a neighboring property is within 1/2 mile of a farm enrolled in a Voluntary Agricultural District or Enhanced Voluntary Agricultural District. In other words, you know that a neighboring property is dedicated to agricultural, horticultural, or forestry production. To be eligible for enrollment into a District or Enhanced District a farm must have a minimum of 5 acres dedicated to horticultural crops, 10 acres dedicated to livestock production, or at least 20 acres dedicated to forestry production.
How Do I Find VADs/EVADs Near My Property or a Property I am Considering Purchasing
Maps and information on the location and establishment of Voluntary Agricultural Districts and Enhanced Districts in Yancey County can be obtained from the North Carolina Cooperative Extension, the Soil and Water Conservation District Office, or the Natural Resource Conservation Office.
